1. Definitions

• Aw: Copyright Act 1912
  
  
• Photographic work: photographic or videographic material as referred to in Aw
  
  
• Image carrier: medium where images were captured (slide, USB stick, download link, etc.)
  
  
• Photographer/Videographer: Studio Haviq B.V.
  
  
• Client: the other party of Studio Haviq B.V.
  
  
• Use: reproduction and/or disclosure in accordance with Aw

2. Applicability

These terms and conditions apply to all legal relationships between Studio Haviq and the client, including offers, oral and written agreements, unless otherwise agreed in writing.

3. Using images for promotion

Studio Haviq may use images made for promotional purposes (website, social media, printing, awards). Objection must be reported in writing before the agreed order date.

4. Copyright

4.1 Studio Haviq reserves the copyright to the footage; commercial use is only allowed with written permission.
4.2 In case of unauthorized use: compensation of at least three times the usual fee (at least €600).
4.3 The portrait falls under the artistic interpretation of Studio Haviq; complaints about appearance will not be honored.

5. Use by client

5.1 Forwarding to commercial parties is not allowed without written permission. 5.2 Publication on private channels is allowed provided that Studio Haviq is named as creator.
5.3 Editing the supplied image is not allowed.
5.4 Agreement must be signed within two weeks of receipt; otherwise, Studio Haviq B.V. reserves the right to accept other orders.

6. Invoice and payment

6.1 Payment takes place on the basis of the invoice, after order but before delivery.
6.2 Complaints on the invoice must be reported in writing within seven working days of the invoice date.

7. Cancellation

7.1 The deposit is non-refundable unless Studio Haviq B.V. decides otherwise.
7.2 In case of cancellation by Studio Haviq B.V. (except in unsafe circumstances), the deposit will be refunded.

8. Liability

Studio Haviq B.V.'s liability is limited to the invoice amount, unless there is gross negligence or intent, or is covered by insurance.

9. Miscellaneous

9.1 The client is responsible for his own well-being.
9.2 In the event of force majeure or illness, Studio Haviq B.V. is only liable for a refund of amounts paid within 10 working days; efforts will be made to replace them without guarantee.
9.3 Complaints about the work must be submitted in writing within five working days of delivery; if justified, they will be resolved within a reasonable period of time.

10. Delivery

10.1 Studio Haviq selects images and delivers only the best images.
10.2 The client receives a digital selection, fully edited in JPG format.
10.3 No delivery of original or unedited files.
10.4 Delivery within four weeks, unless otherwise agreed.
10.5 Digital delivery means that Studio Haviq B.V. is responsible for screen calibration; deviations in physical prints by the client do not in principle lead to replacement or compensation.
10.6 Images are stored for 1-5 years, unused images are deleted after three months.
10.7 The client is responsible for backup; Studio Haviq B.V. is not liable for lost files.

11. Final provisions

• By using the services of Studio Haviq B.V., the client accepts these terms and conditions.
